- Payment Provider: iyzico for card payments in Turkish lira; Plisio for cryptocurrency payments priced in US dollars.
- Platform: the WeSocialLab application at wesociallab.com.
3. Subject of the Agreement
3.1. The subject of this Agreement is to set out the parties' rights and obligations under Law No. 6502 and the Regulation on Distance Contracts regarding the sale of the Package the Buyer orders electronically on the Platform and the provision of the Service during the Package Period.
3.2. Packages differ in the number of X accounts that can be connected (1, 3, 5, 10 or 20), the daily post limit and the image quota. The rules for using the Service are set out in the Terms of Use.
4. Main Characteristics and Price of the Service
4.1. The name, contents, Package Period, total price, currency and payment method of the Package purchased are the details the Buyer sees and approves on the Platform's checkout page before payment. These details form an integral part of this Agreement and, after payment, appear on the payment receipt sent to the Buyer and in the payment history of the account.
4.2. Prices are set and shown in Turkish lira (TRY) for card payments and in US dollars (USD) for cryptocurrency payments. Commissions and charges applied by the card-issuing bank, and network fees and exchange rate differences for cryptocurrency payments, are borne by the Buyer.
4.3. No additional delivery, shipping or service fee applies to the Package.
4.4. The Seller reserves the right to change Package contents and prices prospectively. A change does not affect purchases completed before it or their Package Periods.
5. Payment
5.1. At the Buyer's choice, payment is made in Turkish lira by debit or credit card through iyzico, or in cryptocurrency for the US dollar price through Plisio.
5.2. Card details are not seen, processed or stored by the Seller; payment pages are provided by the Payment Providers. If the Payment Provider does not approve the transaction, or a cryptocurrency payment is underpaid or not completed in time, the Package is not activated and the Agreement is not formed.
5.3. Packages do not renew automatically; no recurring or automatic payment is taken from the Buyer.
5.4. The Buyer agrees to contact the Seller before initiating a chargeback or dispute regarding a payment. In the event of an unjustified chargeback, the Seller reserves the right to end the related Package and suspend the account.
6. Performance and Package Period
6.1. The Service is digital; nothing is shipped. The Package is activated in the Buyer's account on the Platform immediately and electronically once the Payment Provider confirms the payment, and can be used for thirty (30) days.
6.2. Buying the same Package again while it is active extends the current Package Period by thirty (30) days. If a different Package is bought, the new Package starts as soon as payment is confirmed and the previous Package ends; the remaining days of the previous Package are not carried over and are not refunded.
6.3. When the Package Period ends, new content generation and publishing of scheduled posts stop; the Buyer's account and data are not deleted.
6.4. If a Package whose payment was confirmed is not activated because of a technical problem, the Buyer contacts the Seller with the payment reference; after verifying the payment, the Seller activates the Package or, at the Buyer's choice, refunds the price.
7. Right of Withdrawal
7.1. Under Article 15/1-ğ of the Regulation on Distance Contracts, the right of withdrawal does not apply to contracts for services performed instantly in electronic form; under Article 15/1-h, it does not apply to contracts for services whose performance has begun with the consumer's approval before the end of the withdrawal period.
7.2. A Package is a service activated in the Buyer's account instantly and electronically on confirmation of payment and performed continuously throughout the Package Period. By approving the payment, the Buyer has expressly requested and accepted immediate activation of the Package and the start of performance, and acknowledges having been informed before payment, through the Preliminary Information Form, that there is therefore no right of withdrawal.
7.3. The withdrawal exception does not remove the Buyer's rights under Law No. 6502 regarding a defective service. The conditions for a refund or an extension of the period where the Service cannot be used at all for a reason attributable to the Seller, or cannot be provided because of a technical failure, are set out in the Refund Policy.
8. Rights and Obligations of the Parties
8.1. The Seller must activate the Package immediately after payment is confirmed, in accordance with Law No. 6502 and related legislation, and provide the Service with reasonable care throughout the Package Period.
8.2. The Buyer declares and undertakes that the information registered on the Platform is accurate and up to date, that the payment is made in their own name and within their authority, and that the card or cryptocurrency wallet used belongs to them or that they are authorised to use it.
8.3. The Buyer agrees to use the Service in line with the Terms of Use and X's rules and accepts responsibility for content published from their X accounts. In the event of a breach of the Terms of Use, the Seller's right to suspend the account and terminate the Agreement is reserved.
8.4. The Service's publishing feature depends on the X API provided by X Corp. Restrictions or suspensions applied by X to the Buyer's account are not the Seller's responsibility.
8.5. The Buyer confirms that before approving this Agreement they read the Preliminary Information Form and are aware of all the terms of the Agreement.
9. Formation and Term of the Agreement
9.1. This Agreement is formed and takes effect when the Buyer electronically approves the Preliminary Information Form and the Agreement on the checkout page and the Payment Provider confirms the payment; it ends automatically at the end of the Package Period.
9.2. A copy of the Agreement is made available to the Buyer through the payment receipt sent to them, the payment history in the account and the current text published at wesociallab.com. The Buyer can save and print the Agreement.
9.3. The Seller may update this Agreement prospectively. Each purchase is subject to the text of the Agreement in force on the purchase date.
10. Dispute Resolution
10.1. The Buyer may send complaints and requests about the Agreement by email to [email protected] or in writing to 160 City Road, London, EC1V 2NX, United Kingdom. The Seller reviews requests as soon as possible.
10.2. For Buyers resident in Türkiye who qualify as consumers, the mandatory provisions of Turkish consumer law are reserved. These Buyers may apply to the Consumer Arbitration Committees at their place of residence or where the transaction took place, within the monetary limits announced each year by the Ministry of Trade, and to the Consumer Courts for disputes above those limits.
10.3. For Buyers who do not qualify as consumers, this Agreement is governed by the laws of England and Wales and the courts of England and Wales have jurisdiction over disputes.
11. Evidence and Notices
11.1. The Seller's electronic records, transaction records received from the Payment Providers and system logs may be used as evidence in disputes arising from this Agreement; consumers' right to submit counter-evidence is reserved.
11.2. Notices between the parties are given through the email address registered to the Buyer's account and the Seller's email and postal addresses stated above.
12. Entry into Force
12.1. This Agreement, consisting of twelve (12) articles, was concluded and entered into force on the payment date by being approved electronically by the Buyer.
